1. Acceptance of Terms
By downloading, installing, or using the Meshwar application ("App") or accessing any of our services through the website at wasalny.tech (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
These Terms constitute a legally binding agreement between you and Meshwar ("we", "us", "our"). We reserve the right to modify these Terms at any time. Continued use of the Services after modifications constitutes acceptance of the updated Terms.
2. Description of Services
Meshwar is a technology platform that connects passengers seeking transportation with independent drivers who provide ride services. Meshwar is not a transportation carrier, taxi company, or public transit provider. We act solely as an intermediary facilitating connections between passengers and drivers.
3. Eligibility
- You must be at least 18 years of age to create an account and use the Services.
- You must provide accurate, current, and complete registration information.
- You must have the legal capacity to enter into a binding agreement.
- Drivers must possess a valid driver's license, vehicle registration, appropriate insurance, and meet all requirements set by Meshwar and applicable laws.
4. Account Registration
To use the Services, you must create an account using one of the following methods:
- Phone Number: Register and verify your identity via SMS one-time password (OTP).
- Google Sign-In: Authenticate using your Google account via OAuth 2.0.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account.
5. Passenger Terms
5.1 Ride Requests
By submitting a ride request, you agree to pay the fare displayed at the time of booking. Fares are calculated based on distance, estimated time, and applicable platform fees.
5.2 Passenger Conduct
- Treat drivers with respect and courtesy.
- Be at the designated pickup location on time.
- Do not damage the driver's vehicle.
- Do not engage in any illegal activities during the ride.
- Do not request the driver to violate traffic laws or regulations.
- Ensure the number of passengers does not exceed the vehicle's legal capacity.
5.3 Cancellations
You may cancel a ride request before the driver arrives. Cancellation policies and any applicable fees are displayed in the App at the time of cancellation.
6. Driver Terms
6.1 Independent Contractor
Drivers using the Meshwar platform operate as independent contractors, not employees of Meshwar. Drivers retain full control over when and where they provide services.
6.2 Driver Requirements
- Possess a valid and current driver's license.
- Maintain a vehicle that meets Meshwar's safety and quality standards.
- Carry valid vehicle insurance as required by law.
- Pass Meshwar's registration and verification process.
- Comply with all applicable traffic laws and regulations.
6.3 Driver Conduct
- Treat passengers with respect and professionalism.
- Follow the designated route or the most efficient route.
- Maintain a clean and safe vehicle.
- Do not use the platform while impaired by alcohol, drugs, or any substance.
- Do not collect fares outside the Meshwar platform.
6.4 Earnings & Payments
Drivers receive earnings for completed trips minus the applicable platform fee. Earnings are tracked in the App and can be viewed in the Wallet section. Payment terms and withdrawal methods are as specified in the App.
7. Fares & Payments
- Fares are calculated automatically based on distance and the platform's pricing model.
- A platform fee is deducted from each fare to maintain and improve the Services.
- All fare estimates are approximate and may vary based on actual route and conditions.
- Payment is due upon completion of the ride.
- We reserve the right to adjust fares in cases of route deviation, technical errors, or disputes.
8. Safety
Safety is our top priority. Both passengers and drivers are expected to:
- Follow all applicable traffic and safety laws.
- Report any safety concerns or incidents through the App's support feature.
- Not engage in harassment, discrimination, or threatening behavior.
- Not carry weapons, illegal substances, or hazardous materials.
Meshwar reserves the right to suspend or terminate accounts that violate safety standards.
9. Support & Disputes
If you experience any issues during or after a ride, you can submit a support ticket through the Help & Support section in the App. Our support team will review and respond to your case. We handle:
- Ride-related complaints
- Fare disputes
- Lost items
- Safety concerns
- Account issues
- Payment problems
10. Prohibited Activities
You agree not to:
- Use the Services for any unlawful purpose.
- Impersonate another person or entity.
- Interfere with or disrupt the Services or servers.
- Attempt to gain unauthorized access to other accounts or systems.
- Use automated means (bots, scripts) to access or interact with the Services.
- Collect or harvest other users' personal information.
- Use the platform to transport illegal goods or substances.
- Manipulate ratings, reviews, or trip data.
11. Intellectual Property
All content, trademarks, logos, designs, and software associated with Meshwar are the intellectual property of Meshwar. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.
12. Limitation of Liability
To the maximum extent permitted by law:
- Meshwar provides the platform "as is" without warranties of any kind.
- We are not liable for the actions, conduct, or negligence of drivers or passengers.
- We are not responsible for delays, route changes, or service interruptions caused by traffic, weather, or other external factors.
- Our total liability for any claim shall not exceed the amount paid by you for the specific ride giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Meshwar, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Services or violation of these Terms.
14. Account Suspension & Termination
Meshwar reserves the right to suspend or terminate your account at any time for:
- Violation of these Terms of Service.
- Fraudulent or illegal activity.
- Safety concerns or complaints.
- Extended period of inactivity.
- Any reason we deem necessary to protect the platform and its users.
You may also delete your account at any time by contacting support.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt. Any disputes arising from these Terms or the Services shall be resolved through the competent courts in Egypt.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
